These Terms of Service ("Terms") govern your access to and use of the Nityodaya ERP website and School ERP software (the "Service"). By using the Service you agree to these Terms. If you are accepting on behalf of a school, you confirm you are authorised to do so.
1. The Service
Nityodaya ERP provides cloud-based software to help schools manage admissions, fees, attendance, examinations, timetables and communication. Features available to you depend on the subscription plan your school selects.
2. Accounts and access
- The school is responsible for the accounts it creates and for keeping login credentials confidential.
- You agree to use the Service only for lawful purposes and to enter accurate information.
- You must not attempt to disrupt the Service, access it without authorisation, or misuse other users' data.
3. Subscriptions and payment
- Subscriptions are billed annually based on the plan and capacity (students, staff and branches) selected. Current pricing is shown on our Pricing page.
- Invoices are GST-compliant. Fees are payable in advance for each billing period.
- Unless stated otherwise, fees are non-refundable for the current period once a plan is active.
4. Your data
The data your school enters remains yours. We process it as described in our Privacy Policy. You are responsible for ensuring you have the right to enter and process the personal data (including student and parent data) you put into the Service.
5. Availability and support
We aim to keep the Service available and reliable, and to provide support through the channels listed on our website. Occasional maintenance or factors beyond our control may cause temporary interruptions.
6. Acceptable use
You agree not to copy, resell, reverse-engineer or use the Service to build a competing product, and not to upload unlawful, harmful or infringing content.
7. Limitation of liability
The Service is provided on an "as is" basis. To the maximum extent permitted by law, Nityodaya ERP is not liable for indirect or consequential losses. Our total liability for any claim is limited to the subscription fees you paid for the Service in the preceding twelve months.
8. Suspension and termination
We may suspend or terminate access for non-payment or breach of these Terms. You may cancel at the end of your billing period. On termination, you will be given a reasonable opportunity to export your data as described in the Privacy Policy.
9. Changes to these Terms
We may update these Terms from time to time. The "Effective" date above reflects the latest version, and continued use of the Service after changes means you accept them.
10. Governing law
These Terms are governed by the laws of India, and the courts of India shall have jurisdiction over any disputes.
